General terms and conditions of business
§1 Rental object and keys
The landlord rents the following accommodation (“Rental Property”) to the tenant:
Country house "Casa Emilia" for a maximum of 4 people with pool or country house "Villa Atréju" for a maximum of 10 people with pool
- The rental property is fully furnished. Bed and bath linens are included in the rental price.
- During the rental period, the tenant is entitled to use the entire house (except locked cupboards), the garden, and the pool. The following facilities are also available for free use: parking, washing machine, satellite TV, and a mini stereo system with DVD player.
- The tenant receives 1 front door key, 1 key for the entrance gate for the duration of the rental period
- The rental property is rented to the tenant for an agreed period of time and may not be used for permanent residential purposes.
§2 Legally binding booking
A legally binding rental agreement for a specific period is concluded with the booking
- With a completed and signed booking form, which you send to the landlord by email or post.
- If you initiate the booking via our website by entering the required information and payment details, you will receive a booking confirmation via email after confirming your details. In this case, the rental agreement is binding even without the signature of the landlord and/or tenant.
§3 Arrival and departure, stay
- On the day of arrival, the rental property is ready for occupancy from 3:30 p.m.
- The rental property must be returned by 10:00 a.m. on the day of departure.
- The landlord will provide the tenant with a designated receptionist on-site, who can arrange key handover by phone. The receptionist will also explain everything important about the rental property on-site and will be available to answer any questions during the stay.
- At the end of the rental period, the tenant must return the rental property in good condition with the keys handed over to the landlord's guest service.
- The rental property must be left in a clean and tidy condition. All used dishes must be washed, the dishwasher emptied, and the oven and grill cleaned.
- The tenant must dispose of the garbage before departure.
§4 Rental price, deposit and method of payment
- The rental price includes additional costs such as electricity, water, Wi-Fi, towels and bed linen.
- The costs for final cleaning are included in the rental price.
- Firewood is not included in the rental price.
- Optionally, the tenant can book gas for the central heating.
- The rental price is payable as follows: A 30% deposit is due immediately upon signing the contract. The remaining balance is due no later than four weeks before the start of the rental period. If less than 28 days elapse between the signing of the contract and the start of the rental period, the entire rental price is due immediately.
- The landlord accepts payments by credit card / PayPal / bank transfer
- Unless otherwise stated, all payments will be processed through the website with the URL/address www.casa-emilia.com or www.villa-atreju.com.
- PayPal payment requests are made from the following account: info@casa-emilia.com or info@villa-atreju.com
- If the tenant is more than 7 days late with payment, the landlord is entitled to terminate the contract without notice and rent the property to someone else.
- The deposit of €200.00 must be paid in cash to the landlord's guest service upon arrival and will be refunded upon departure if the property is handed over in good condition.
§5 Cancellation and termination of stay
- If the tenant cancels (terminates) the contract before the start of the rental period without naming a replacement tenant who will enter into the contract under the same conditions, the following pro rata rent (excluding final cleaning) must be paid as compensation, taking into account the saved expenses, if re-letting is not possible: Cancellation up to 70 days before the start of the rental period: 30% of the rental price; up to 56 days before the start of the rental period: 50% of the rental price; up to 42 days before the start of the rental period: 80% of the rental price; up to 28 days before the start of the rental period: 90% of the rental price; otherwise (later than 14 days before the start of the rental period): 100% of the rental price. The landlord will nevertheless endeavor to rent the property to someone else. The tenant is entitled to provide evidence of lesser damages at any time.
- If the tenant terminates the stay prematurely, he remains obliged to pay the full rental price.
- Cancellation or termination can only be made in writing. The receipt of the notice of termination by the landlord is decisive.
§6 Liability and obligations of the tenant
- The rental property, including the furniture and other items located therein, must be treated with care. Accompanying persons and/or visitors must be instructed by the tenant to exercise due care. The tenant is liable for any damage to the rental property, furniture, or other items located therein caused by the tenant or his or her accompanying persons.
- Defects that occur upon taking over the rental property and/or during the rental period must be reported to the guest service immediately and in an appropriate form.
- Keeping animals in the rental property is not permitted.
- The landlord expressly points out that the rental property is located in a rural part of a mountain village and assumes no liability for injuries, accidents, or other damage that may occur to the tenant or accompanying persons in this context. Likewise, the landlord excludes liability for cash or property belonging to the tenant. Likewise, liability for health damage that may arise from the use of the swimming pool or other items in the rental property is excluded. The tenant must exercise particular caution when traveling with children.
- The rental property may only be occupied by the maximum number of people specified for the country house. Violation of this clause may result in immediate termination of the rental agreement. In this case, the landlord is entitled to evict the tenant and all accompanying persons from the house and retain all payments made.
- The tenant agrees to comply with the information brochures and house rules available upon arrival. The place of jurisdiction is the country of residence of the landlord/owner.

House rules
Generally
- When leaving the house, always close all windows and doors to prevent unauthorized entry from outside.
- Close windows and patio doors when using the air conditioning and/or heating to ensure optimal efficiency and save energy.
- To ensure proper functioning, no changes may be made to the programmed settings of timers, televisions, or remote controls. This applies especially to the pool pump and garden irrigation system.
- Park your private vehicle or rental car in the designated parking space at the holiday home.
- Under no circumstances should animals be allowed into the house and/or stray cats and/or dogs be fed, as they would otherwise become accustomed to the property.
- Please always dispose of garbage bags in the municipal garbage bins provided for this purpose.
- Please return borrowed books to the library before you leave.
- Do not use upholstered furniture or similar items while wearing wet swimwear. This also applies to the use of sunscreen.
- Do not take towels from the house to the beach.
- Do not leave pillows outside overnight or in bad weather.
- When using the washing machine, open and close the water supply before and after use using the lever tap.
- If you are not satisfied with your booking, please inform us immediately. After the rental period has expired, we can no longer accept any claims for damages. We will, of course, endeavor to find a satisfactory solution for you as soon as possible.
Kitchen
- When preparing strong-smelling foods, please always use the extractor fan.
- We ask you to clean the grill and oven after use, otherwise we will charge a separate cleaning fee in addition to the deposit.
- We ask that you do not leave any perishable food in the cupboards or refrigerator when you leave.
Living Room
- Please read the instruction manual before using the fireplace. To light the fireplace in the living room, use only the provided firelighters with dry, thin wood and/or dry pine cones (not paper). Firewood is not included in the rental price. You can purchase wood at the gas station or at the Portichuelo hardware store in Venta de Palma.
- No changes may be made to the programmed settings of the television, stereo system or remote controls.
Bath
- Don't forget to turn off the heaters when you use them.
Outdoor Area
- The entrance gate must be kept closed at all times. Locking it with the locking latch is sufficient.
- The parasols must remain closed overnight, when you are away and in strong winds.
- The sun loungers and garden furniture must be put back in their place before departure.
- Don't leave food scraps lying around in your house or outdoors. This attracts pests and ants, which are difficult to get rid of.
